By downloading, installing, or using the Breath app ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Breath is a mobile application designed to guide users through various breathing exercises and techniques. The App provides:

  • Guided breathing exercises with visual and audio cues
  • Multiple breathing techniques including Box Breathing, Resonant Breathing, and more
  • Dive Mode for freediving and apnea training
  • Progress tracking and statistics
  • Customizable session settings

3. Medical Disclaimer

Important: The Breath app is designed for general wellness purposes only and is NOT intended to diagnose, treat, cure, or prevent any disease or medical condition. The information and exercises provided should not be considered medical advice.

Before starting any breathing exercise program, especially the Dive Mode features, you should:

  • Consult with a qualified healthcare provider
  • Inform your doctor if you have any respiratory conditions, cardiovascular issues, or other health concerns
  • Stop immediately if you experience dizziness, shortness of breath, chest pain, or any discomfort

3.1 Dive Mode Safety Warning

Breath-hold training can be dangerous. Never practice breath-holding exercises alone, in water, while driving, or in any situation where loss of consciousness could be hazardous. The Dive Mode features are for dry land training only. Shallow water blackout can occur without warning and can be fatal.

4. User Responsibilities

By using the App, you acknowledge and agree that:

  • You are at least 18 years old, or using the App under adult supervision
  • You will use the App responsibly and follow all safety guidelines
  • You are solely responsible for your health decisions and any consequences of using the App
  • You will not use the App for any breath-hold activities in water
  • You will practice breathing exercises in safe environments only

5. Intellectual Property

All content within the App, including but not limited to text, graphics, logos, animations, audio, and software, is the property of Breath App and is protected by copyright and other intellectual property laws. You may not:

  • Copy, modify, or distribute the App's content
  • Reverse engineer or attempt to extract the source code
  • Use the App's content for commercial purposes without permission

6. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

7. Limitation of Liability

To the maximum extent permitted by law, Breath App and its developers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the App, including but not limited to personal injury, health issues, or any other damages.

8. Indemnification

You agree to indemnify and hold harmless Breath App, its developers, officers, directors, and employees from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

9. Modifications to the App

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We may also update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.

10. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Breath App operates, without regard to its conflict of law provisions.

13. Severability
