1. Acceptance of Terms

By downloading, installing, accessing, or using FFH ("App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree with these Terms, do not use the App.

2. Description of the App

FFH is an outdoor activity logging application for iPhone, Apple Watch, and related Apple platform features. Depending on the version of the App you use, FFH may allow you to:

• Create and manage fishing, foraging, and hunting trips
• Record trip routes, time, pauses, and catch or find locations
• Add photos, notes, and trip metadata
• Sync trip state between iPhone and Apple Watch
• Use Live Activities to view trip status
• Use AI-assisted fish identification features
• Create or restore backups through iCloud-enabled features

3. Outdoor Safety Disclaimer

You agree that you will use your own judgment and take appropriate precautions, including where relevant:

• Checking weather, water, terrain, trail, and local field conditions
• Following firearm, hunting, boating, and outdoor equipment safety practices
• Using proper identification resources before handling or consuming fish, mushrooms, plants, or wild game
• Maintaining adequate communication, lighting, and emergency planning for your trip
• Never relying solely on the App for emergency, medical, navigational, or wildlife identification decisions

You are solely responsible for understanding and complying with all laws, regulations, permit requirements, bag limits, protected species rules, seasons, land access restrictions, and local conservation rules applicable to your activities.

4. AI and Automated Suggestions

The App may include AI-assisted or model-based identification and classification tools. These features are provided for informational and convenience purposes only. We do not guarantee that any prediction, label, confidence score, or automated result is accurate, complete, current, lawful to rely upon, or suitable for your specific use.

5. Accounts, Purchases, and Premium Features

Some versions of FFH may include optional sign-in, subscriptions, or premium features. If offered, billing, cancellations, renewals, and refunds may also be subject to Apple App Store rules and any applicable third-party billing provider terms. Premium access may be changed, suspended, or discontinued at any time to the extent permitted by law.

You retain ownership of photos, notes, and trip records you create in the App. You are responsible for ensuring that content you create, store, or share through the App does not violate law or third-party rights. You represent that you have the right to use any content you upload or save in connection with the App.

7. Acceptable Use

You agree not to:

• Use the App for unlawful, harmful, fraudulent, or misleading purposes
• Use the App in a way that endangers yourself or others
• Reverse engineer, decompile, copy, or attempt to extract source code except where prohibited by law
• Interfere with App functionality, security, or service availability
• Use the App to infringe intellectual property, privacy, publicity, or other legal rights

Except for user content you create, the App and its software, design, branding, text, layouts, graphics, and related materials are owned by Aetivio or its licensors and are protected by applicable intellectual property laws.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how information is handled in connection with FFH.

10. Availability and Changes

We may modify, update, suspend, restrict, or discontinue any part of the App at any time. Features may change across releases, devices, operating systems, or territories. We are not obligated to maintain any particular feature, integration, or compatibility indefinitely.

You agree to defend, indemnify, and hold harmless Aetivio and its affiliates, developers, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of your use of the App, your activities in the field, your user content, or your violation of these Terms or applicable law.

We may suspend or terminate your access to the App or any related service at any time, with or without notice, if we believe you have violated these Terms, created risk, or used the App in an improper manner.

15. Governing Law

These Terms are governed by the laws applicable in the jurisdiction in which the App operator is established, without regard to conflict of law rules, except where mandatory consumer protection laws provide otherwise.
